What are the steps in the compensation procedure?

1 – Analysis of your situation and case assessment

The first step is the analysis of your situation in order to determine the third party’s liability, your entitlement your entitlement to compensation and the further steps to be taken.

We also discuss fees and you’ll receive a fee agreement.

At the end of our first appointment, you are asked to send us all the evidence and elements related to your case (for ex. accident report, police report etc.)

2 – Contact with the insurance company

We contact the insurer covering the accident in order for your case to be opened and handled.

3 – Setting up your claim

Together, we prepare and compile your medical file and the firm helps you to gather up the entire medical file from the health care provider. Also, it is important to collect all the evidence related to your injury and other financial documents.

4 – Setting up an out-of-court or judicial medical examination and obtaining an advance payment for the compensation

Depending on your situation and the injury suffered, we will request an out-of-court (organized by the insurer) or court-ordered medical assessment.

At the same time, we request the insurer to make an advance payment of your final compensation.

5 – Medical assessment

The assessment of the consequences of your injury is done by a physician that can be appointed either by the insurer (out-of-court) or the court. This a key step in your compensation claim.

We will schedule a meeting prior to the assessment and our firm will explain you what to expect and how this evaluation will be conducted. Of course, you’ll be assisted by Mrs. Honzikova during the assessment. Our firm will be there for you.

In most cases, the presence of another physician acting on your side is strongly recommended since it helps to guarantee the medical findings to be accurate.

Following the medical assessment meeting, the physian drafts a medical report with the medical findings and assessment of your consequences.

6 – The amount of your compensation

On the basis of the abovementioned report and your situation (medical, financial, professional and personal), Mrs. Honzikova will calculate the compensation that you should be entitled to.
